§ 1 Scope of application. The following General Terms and Conditions of Business shall apply exclusively to business relations between LÜSCHER-COLOR-DIAGNOSTIK AG and the Purchaser.
§ 2 Conclusion of contract. When the customer sends an order, it is confirmed by e-mail. If it is not cancelled within 24 hours, delivery will be made immediately after receipt of payment.
§ 3 Delivery, shipping costs, transfer of risk, returns
Delivery is made with the additional shipping costs. All risks and dangers of shipment shall pass to the customer as soon as the goods have been handed over by LÜSCHER-COLOR-DIAGNOSTIK AG to the commissioned logistics partner.
Return of the goods is not possible.
§ 4 Retention of title
The delivered goods shall remain the property of LÜSCHER-COLOR-DIAGNOSTIK AG until all claims against the Purchaser have been settled in full.
§ 5 Payments
The customer has the option of either paying in advance or paying by credit card online via the standard SSL or SET procedure. In the case of advance payment, the goods shall be dispatched after receipt of the invoice amount by LÜSCHER-COLOR-DIAGNOSTIK AG.
§ 6 Notice of defects and warranty
The client is responsible for inspecting the ordered goods immediately upon receipt and for notifying LÜSCHER-COLOR-DIAGNOSTIK AG in writing of any defects or deviations from the order within seven calendar days.
The customer shall be entitled to rectification of defects or replacement if the delivered goods have a defect. LÜSCHER-COLOR-DIAGNOSTIK AG shall have the right to choose the type of remedy. Insignificant deviations from warranted characteristics of the goods shall not trigger any warranty rights.
All further legal provisions on warranty, in particular reduction and rescission, are excluded — as far as legally permissible.
§ 7 Liability
Liability of LÜSCHER-COLOR-DIAGNOSTIK AG is excluded — to the extent permitted by law — unless the damage is due to intend or gross negligence. In no event shall LÜSCHER-COLOR-DIAGNOSTIK AG be liable for slight negligence, indirect/mediate damage and consequential damage, loss of profit, unrealized savings or damage resulting from delay in delivery.
Furthermore, LÜSCHER-COLOR-DIAGNOSTIK AG rejects liability in the event of improper storage or use of the goods or similar by the customer or a third party in breach of the contract.
§ 8 Data protection
The transmission of your data when paying by credit card is carried out using the standard SSL or SET procedure, which continuously encrypts data between you and our web server. This means that your personal data such as name, address, or credit card number cannot be read by outsiders during the safer-pay payment process.
Your data will, of course, not be passed on to third parties. The details of the orders are used exclusively for business processing. Our data protection regulations can be found here. By agreeing to these terms and conditions, you agree to this privacy policy.
§ 9 Final provisions
§ 9.1 Place of performance
The place of performance for payments shall be the registered office of LÜSCHER-COLOR-DIAGNOSTIK AG.
§ 9.2 Applicable law and place of jurisdiction
The contractual relationship between LÜSCHER-COLOR-DIAGNOSTIK AG and the customer as well as the respective terms and conditions shall be governed by Swiss law. The application of the Vienna Sales Convention is excluded. The exclusive place of jurisdiction shall be the Civil Court of Basel-Stadt, unless another mandatory statutory place of jurisdiction exists.
§ 9.3 Amendment of the General Terms and Conditions
LÜSCHER-COLOR-DIAGNOSTIK AG reserves the right to amend the General Terms and Conditions at any time.
